Terms of Service
← Back to storeThese Terms of Service ("Terms") are a legal agreement between you and EXTRAVOX AI, LLC ("ZUZ AI", "we", "us"), a limited liability company registered in the United States at 131 Continental Dr, Suite 305, Newark, DE 19713. They govern your use of the ZUZ AI platform at https://app.zuz-upgrade-ai.com and any plan you buy from this store.
By buying a plan or using the platform you accept these Terms. If you do not accept them, do not use the service.
1. What ZUZ AI is
ZUZ AI is a no-code platform for building AI voice assistants that answer inbound telephone calls and place outbound calls on your behalf. You configure an assistant in plain language, connect a telephone number, and the assistant handles calls according to your instructions.
ZUZ AI is a tool. You decide what your assistants say and who they call, and you are responsible for those decisions.
2. Eligibility
You must be at least 18 years old and able to enter a binding contract. If you use ZUZ AI for an organisation, you confirm you are authorised to bind that organisation to these Terms.
3. Plans bought from this store
Plans purchased through this store are one-off purchases for a fixed period of access. This is important, so we will be plain about it:
- Nothing renews automatically. You are not enrolled in a subscription and you will not be charged again. When the period ends, access stops until you choose to buy another period.
- Each plan includes a fixed allowance of call minutes for that period. The allowance resets at the start of each new period and does not roll over.
- Buying while you still have time remaining adds to it. The new period is added to the end of your current one, so you never lose time you have paid for.
- Plan limits — included minutes, number of assistants, number of phone numbers — are shown on the plan at the point of purchase and apply for that period.
Access is delivered electronically and is normally available within minutes of payment. See our Delivery Policy.
4. Your account
You are responsible for keeping your login credentials secure and for everything done through your account. Tell us promptly at support@zuz-upgrade-ai.com if you believe your account has been accessed without your permission.
5. Telephone calls, recording and consent
This section matters more than any other. Read it.
5.1 You are responsible for how calls are made
ZUZ AI places and answers calls on your instructions. You — not ZUZ AI — are responsible for ensuring those calls comply with the law in every jurisdiction you call into. Depending on where you and the called party are, that may include:
- Telephone consumer protection and automated-calling rules, including in the United States the Telephone Consumer Protection Act (TCPA) and applicable state equivalents, which restrict automated and pre-recorded calls to consumers without prior express consent.
- National and internal do-not-call registers.
- Permitted calling hours.
- Rules requiring accurate caller identification. You must not use ZUZ AI to misrepresent who is calling.
5.2 Call recording consent is your obligation
Calls made through ZUZ AI are recorded and transcribed so that you can review them. Recording a telephone call without adequate consent is unlawful in many places. Several US states require the consent of every party to the call, and in the United Kingdom, the European Economic Area and other jurisdictions, recording requires a lawful basis and clear notice.
You are responsible for obtaining any consent required and for giving any notice required before a call is recorded. We strongly recommend configuring your assistants to announce at the start of each call that the call is being recorded.
5.3 Telling people they are speaking to an AI
Some jurisdictions require that a person be told when they are interacting with an automated system rather than a human. You are responsible for meeting any such requirement, and we recommend that your assistants disclose that they are automated.
5.4 Emergency calls
ZUZ AI is not a telephone service and must not be relied on to reach emergency services. Do not configure assistants to place emergency calls.
6. Acceptable use
Your use of ZUZ AI is subject to our Acceptable Use Policy, which forms part of these Terms. Breaching it may result in suspension or termination.
7. Fees, taxes and payment
Prices are shown at checkout in the currency indicated and are exclusive of taxes unless stated otherwise. Applicable sales tax, VAT or GST is calculated and shown at checkout based on your location.
Payment is taken at the time of purchase by our payment provider. We do not store your full card details.
8. Refunds and cancellation
Because plans bought here do not renew, there is nothing to cancel — a plan simply ends. Refunds are governed by our Refund Policy, which sets out when a refund is available and how to request one, and which preserves any statutory rights you have as a consumer.
9. Service availability
We work to keep ZUZ AI available and reliable, but we do not guarantee uninterrupted service. We may carry out maintenance, and we depend on third parties including telephony and AI providers whose outages can affect the service. We will give reasonable notice of planned maintenance where we can.
10. Your content and your customers' data
You keep ownership of the instructions, prompts, knowledge bases and other material you put into ZUZ AI, and of the call recordings and transcripts generated for your account. You grant us the licence needed to host and process that material in order to provide the service.
Where your assistants handle personal data belonging to your own customers, you are the data controller and we act as your processor. See our Privacy Policy.
11. Our intellectual property
ZUZ AI, its software, interfaces and branding remain our property. Nothing in these Terms transfers ownership to you. You may not copy, reverse engineer or resell the platform except as the law expressly permits.
12. Suspension and termination
We may suspend or terminate your access if you materially breach these Terms or the Acceptable Use Policy, if we are required to by law, or if your use poses a security or legal risk to us or others. Where the circumstances allow, we will contact you first and give you a chance to put things right.
If we terminate your account for something other than your breach, we will refund the unused portion of any period you have paid for.
13. Disclaimers
AI voice assistants can misunderstand, mishear, or produce inaccurate output. ZUZ AI is provided "as is" and, to the fullest extent the law allows, we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement.
Do not use ZUZ AI as the sole means of handling anything where an error could cause harm — medical, legal, financial or safety-critical matters included.
14. Limitation of liability
To the fullest extent permitted by law, and except where these Terms say otherwise:
- Neither party is liable for indirect, incidental, special or consequential loss, or for loss of profits, revenue, goodwill or data.
- Our total aggregate liability arising out of or relating to the service is limited to the amount you paid us in the twelve months before the event giving rise to the claim.
Nothing here limits liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence, or for fraud. If you are a consumer, this section does not affect your statutory rights.
15. Indemnity
You will indemnify us against claims, losses and reasonable costs arising from your use of ZUZ AI in breach of these Terms or the law — in particular claims arising from calls you made, recordings you took, or consent you failed to obtain.
16. Changes to these Terms
We may update these Terms. If a change materially reduces your rights we will give at least 30 days' notice by email or in the dashboard before it takes effect. Changes do not apply retrospectively to a period you have already bought.
17. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. The courts of that state have exclusive jurisdiction, except that if you are a consumer resident elsewhere, you keep the benefit of any mandatory protections and the right to bring proceedings in the courts of your place of residence.
Before starting formal proceedings, please contact us at legal@zuz-upgrade-ai.com. Most disputes can be resolved quickly that way.
